Haryana State  Employment Act ,2020 has been passed by the Haryana  govt on 2march,2021 and notified in the official gazette.This act  gets attention almost all over India for different reasons The Act covers private companies,socities,trusts ,and partnership firms in the state ..

The act states some keys things denotatively and connotatively

 

What does it carry within it

The bill carries several things in itself here is some key provision of it

 

For harayna resdients

·       Every resident holding hayana’s  domicile will be eligible to get benefits in it

·       One can get benefit of it  by registering on the portal

·       There is  ceiling on the post above salary of Rs 50000

 

For companies-

·       Companies will update their portal after every three months ,quoting the vacancies of post below 50000rs  salary

·        If the company doesn’t find suitable candidate for the post then deputy commissioner or higher office will take decision upon this

·       If the higher authorithy didn’t satisfied then company wil have  option to fill appeal within 60 days

 

Penality

·       If the companies doesn’t fullfills the said requirement of the  law then fine can  be  imposed upto rs 200,000 and there can  blockage of subsidy or fine of rs 100 per day

The disentment  from the industry and opposition

While  this alliance is patting their back on this new enactment of the act but they are faceing resent from the industry

Some the major players of the market and commercial are showing their resentment to this act

They are saying that the BJP led govt should reconsider this law and they also suggested  for  consultation with the industry  

 

Here is few reaction from the industry association and allies

Deepak Jain, president, ACMA, said, “Our industry requires skilled workforce to produce high quality products that are globally competitive. Hiring in our sector is done on the basis of merit and talent rather than the domicile of the candidates. The reason for the industry to employ candidates from outside the State is due to the shortage of adequately skilled and locally available manpower.”

 

 

“Investors and entrepreneurs need to source the best human resources available in the country to be competitive and successful. To force them in such a regressive straightjacket will force them to look beyond Haryana and this will ultimately hurt the interests of the State,” Uday Shankar, president, Federation of Indian Chambers of Commerce & Industry (FICCI), said on Thursday.

 

“The new law is a major setback for the micro small and medium enterprises bringing such laws is backward thinking at a time when we are talking about one nation or expanding the horizons at the global level for growth the state by creating hindrance through laws would damage its industrial sector I would say the industry in NCR in Haryana would be badly hit by the law” MOHIT JAIN (CHAIRMAN MSME,HARYANA)

Extrapolating to 4 lakh IT-ITES employees, the Act will overall impact about 1.5 lakh current jobs (37 percent of all the IT/ITeS jobs). Given that the Act applies to new hires, the impact is expected to be severe in 1-2 years as the industry sees a high attrition rate,”  nasscom report said

 

Trade board president

 

·       Vypar Mandal State President Bajrang Das Garg said that the govt, shoul have start the business and industry that have been stoped due to corona before enacting these laws

 

 

Reaction from the opposition

I am not against the people of the other states , but it is the responsibility of every government to safeguard the rights of the people of its own state.In many states local residents have been given priorty in jobs and in such situation ,Haryana also has the right to do this,” leader of opposition Bhupender Singh Hooda

 

Reply from the govt. (BJP+JJP).

From the alliance Dushyant Chautala seems to be on forfront for being in defense of the act , because it was key poll promise in the JJP manisfesto.  

 

DUSYANT CHAUTALA said that Haryana is constantly facing grave unemployment and it is highest in the Country so it was quite neccessory to bring this act in favour of Haryana residents.He  added that in Haryana, lakhs of acre land has been acquised earlier and industries estsblished there .But not even 15% of haryana domicle holders gets the job  and if you calculate the salaried employees of 1 lakh rupees  they are not even 1%.According to different surveys it is evident that in Gurugram region there are not even 15% Haryana domicle holders residing .

The 75 percent reservation in private sector jobs for Haryana locals is only for those with salaries below Rs 50,000 per month. That too, only for non-technical jobs. This reservation rule is not being implemented on technical jobs,” Khattar said in an interview with a private website

 

Writer’s take

 

If look into this we will able to inference  that it was  key poll promise from the JJP  but in pressure from the farmers agitation  and allince with JJP , Bjp have to take this decision to pass this act , although even BJP central leadership is not  happy about it . Finance minister Nirmala Sitharaman’s reaction make attestion of it . She said  that this decision of haryana govt she didn’t get . Although she also added that she is not aware of complete facts

Dushyant Chautala has been getting key postion now a days , this act witnesses  of this point besides in the recent annual  budget   allocation of Haryana . Dushyant got 1433 cr increment in comparison of last  year. According to the budget  data he is now holding postion in both parties at third no. after Anil vij and Kanwar pal gurjar

Dushyant said that the this act is passed due to the influx of unemployment which is quite okey as if we look into the data in 2019-2020

Haryana is witnessing flood of unemployment

But if we look from  the companies side they are also making valid points as this act will bring inspecter raj and other formalities make burden of files and may be they will not get suitable candidates for the jobs then they may face difficulties in recruitment and appeals to higher authorties  may waste their significant time

Here Haryana Cm khatter reply to  a  private website came into force wbhich states  that this act is applicable only for non technical jobs

Many of peoples are quoting article 16 and making allegation this is infringement of constitution  ,Dushyant replied to this as it is  not such infringement because there are several states  who  already made applicable such acts 

We can say that government hardly cares for laws and regulation they  have to just lure voters whaterver the way they can

We can say this is also this type of move

 

Haryana Residents surely getting benefits of this  if the companies doesn’t disinvest or take step back

Haryana welfare industry association has also appealed the Punjab and Haryana high court to look into this

Haryana Bjp is not having option but just to support Dushyant because they  don’t want to take any risk at the time of Farmers agitation where Dushyant Chautala is encashing the oppurtunities
